REGULATIONS FOR THE MACIEJKA.PL INTERNET SHOP
1. Definitions
Terms used in the Regulations mean:

Client - a natural person, a legal person or an organizational unit that is not a legal person, the specific legal provisions of which grant legal capacity, which orders within the framework of the Store;

Customer – A Client who is a natural person and meets the criteria specified in the definition in art. 22 [1] of the Civil Code. According to this definition, a Consumer is a natural person making a legal transaction with an entrepreneur not directly related to its business or professional activity.

Civil Code – Act of 23 April 1964 (Journal of Laws No. 16, item 93, as amended);

Regulations – these Regulations for the provision of electronic services as part of the online store maciejka.pl

Online store (Store) – internet service available at maciejka.pl through which the customer may in particular place Orders;

Goods – products presented in the Online Store;

Sales agreement – contract for the sale of Goods within the meaning of the Civil Code, concluded between Maciejka Footwear Sp. z o.o. Sp. J. and the customer, concluded using the Store's website;

Consumer Rights Act – Act of 30 May 2014 on consumer rights (Journal of Laws of 2014, item 827);

The Act on the provision of electronic services – Act of 18 July 2002 on the provision of electronic services (Journal of Laws No. 144, item 1204, as amended);
- Order – Customer's declaration of intent, aimed directly at the conclusion of the Sales Agreement, specifying in particular the type and number of the Goods.

GDPR – Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and the repeal of Directive 95/46 / EC (general regulation on data protection).
2. General provisions:

These Regulations define the rules for using the online store available at: maciejka.pl and is the regulations referred to in art. 8 of the Act on the provision of electronic services.

The online store, operating at: maciejka.pl, is run by Maciejka Footwear Sp. z o.o. Sp. J., registered in the register of entrepreneurs under number 0000897213, the registration files of which are kept by the district court Poznań - Nowe Miasto and Wilda in Poznań, IX Commercial Division of the National Court Register, with REGON number 302371748 and NIP number 7842489784

These Regulations specify in particular:

the rules for registering and using an account as part of the Online Store;

terms and conditions for making an electronic reservation of products available as part of an online store;

terms and conditions for submitting orders via e-commerce online;

the principles of concluding Sales Agreements with the use of services provided as part of an online store.

The use of the Online Store is possible provided that the IT system used by the Customer meets the following minimum technical requirements:

having a computer or multimedia device connected to the Internet;
-
web browser supporting technologies: HTML, JavaScript, CSS (enabled support for these functions);
- possession of an e-mail address.

In accordance with applicable law, Maciejka Footwear Sp. z o.o. Sp. J. reserves the right to limit the provision of services via the Online Store to people who have reached the age of 18 years. In this case, potential customers will be notified of the above.

Customers can access these Regulations at any time via the link found on the main page of the site "Regulations" and save its content and prepare a printout.
3. The rules of using the Online Store

In order to ensure the security of the transmission of messages and data in relation to the services provided on the Website, the Online Store takes technical and organizational measures appropriate to the degree of security threat to the services provided, in particular measures to prevent the acquisition and modification of personal data sent via the Internet by unauthorized persons.

The customer is obliged to:

not providing or forwarding content prohibited by law, e.g. content that promotes violence, defamatory or violates personal rights and other rights,
-
use the online store in a way that does not interfere with its operation, in particular through the use of specific software or devices,
-
use the online store in a manner consistent with the provisions of the law in force on the territory of the Republic of Poland, the provisions of the Regulations, as well as the general principles of using the Internet.

4. The procedure of conclusion of the Sales Agreement

Information about the Goods provided on the Store's websites, in particular their descriptions, technical and functional parameters as well as prices, constitute an invitation to conclude a contract, within the meaning of art. 71 of the Civil Code.

In order to conclude a Sales Agreement via the Online Store, go to the website maciejka.pl, make a selection, taking further technical steps based on the messages displayed to the Customer and information available on the website.

The selection of the Goods ordered by the Customer is made by adding them to the basket.

During placing the Order - until clicking on the "ORDER WITH OBLIGATION TO PAY" button - the Customer has the possibility to modify the entered data and the selected Good. To do this, follow the messages displayed to the Client and the information available on the website.

After providing the Customer using the Online Store with all necessary data, a summary of the placed Order will be displayed. The Order summary will contain information about:

the Goods of the order;
-
unit and total price of ordered products or services, including delivery costs and additional costs (if any);

the chosen payment method;
-
the selected delivery method;
-
delivery time.

In order to send an Order, it is necessary to provide personal data marked as mandatory and press the button "ORDER WITH OBLIGATION TO PAY".

Sending the Order by the Customer is a declaration of intent to conclude with Maciejka Footwear Sp. z o.o. Sp. J. Sales contracts, in accordance with the Regulations.

After placing the order, the customer receives an e-mail entitled: "You have placed the order number ...", containing the order number in the title and final confirmation of all essential elements of the Order.

The contract is treated as concluded with the moment the Customer receives the e-mail referred to above.

The contract is concluded in Polish. Consolidation, security and access to the Order data and general terms and conditions (Online Store Regulations) is via e-mail.
5. Delivery
The delivery of the Goods is available on the territory of the Republic of Poland and to selected countries and takes place at the address indicated by the Customer while placing the Order.
Delivery of the ordered Goods is carried out by courier service, courier parcel delivery or InPost parcel lockers

Delivery costs will also be indicated at the time of placing the Order.

The delivery deadline is maximum 7 business days from the date of sending the Order by the Customer.
6. Prices and payment methods

Commodity prices are given in Polish zloty and include all components, including VAT tax.

The customer has the option to pay the price:

Cash on delivery upon delivery from the carrier selected when placing the Order;

Electronic payments and a payment card via Przelewy24, according to information made available as part of the Online Store. The payment card operator is PayPro SA Agent Settlement, ul. Kanclerska 15, 60-327 Poznań, entered into the Register of Entrepreneurs of the National Court Register kept by the District Court Poznań New Town and Wilda in Poznań, 8th Commercial Division of the National Court Register under the number KRS 0000347935, NIP 7792369887, Regon 301345068.

7. Withdrawal from the Agreement

The right to withdraw from the Agreement:
-
The Customer who is a Consumer has 30 days to withdraw from the Agreement. The consumer has the right to withdraw from this Agreement within 30 days without giving any reason. The deadline to withdraw from the Agreement expires after 30 days from the delivery of the Goods to the Consumer or to a third party designated by him, other than the carrier.

To exercise your right of withdrawal from the Agreement, you must inform us of your decision to withdraw from this Agreement by way of an unambiguous statement (for example, a letter sent by mail or e-mail to the address bok@maciejka.pl).

You can use the model withdrawal form (download the document), but it is not mandatory.
- To keep the deadline to withdraw from the Agreement, it is sufficient for you to send information regarding the exercise of your right to withdraw from the Agreement before the deadline to withdraw from the Agreement.
- Please return the Goods in their original packaging and protect them in a protective packaging. Please do not stick adhesive tape on the original packaging during transport.
- The customer is responsible for reducing the value of the item as a result of using it in a way that goes beyond what is necessary to establish the nature, characteristics and functioning of the item. In order to determine the nature, characteristics and functioning of things, the Customer may normally open or unpack the package to check the features and functioning of the goods and test it in a manner customary in stationary stores. The customer can try on the product, but cannot wear and use it. The customer can open the original packaging, but cannot destroy or stick to it. The customer is responsible for the damage caused. Pursuant to Art. 34 sec. 4 of the Act in question, the consumer is responsible for reducing the value of the item as a result of using it in a way that goes beyond what is necessary to establish the nature, characteristics and functioning of the item.
- Differences resulting from individual parameter settings of the Consumer's monitor and / or computer (color, proportions, etc.) cannot be the basis for a complaint about the purchased goods. However, the consumer has the right to withdraw from the purchase within 30 days from the date of receipt of the package without giving any reason.

Effects of withdrawal from the Agreement:

In the case of withdrawal from this contract, we will refund you the price of the goods and delivery costs up to the cheapest form of delivery available in our offer. Additional costs resulting from the selection of a delivery method other than the cheapest delivery are not refundable, in particular the cost of payment on delivery is not refundable. The refund is made immediately, and in any case no later than 30 days from the day on which we were informed of your decision to exercise the right to withdraw from this Agreement. The refund will be made at no additional cost to the bank account you specify, which number should be provided in the return form. In the case of payment made by Przelewy24, the refund will be made via this website. You bear the full cost of delivering the goods to us in connection with exercising your right to withdraw from the contract.

Goods should be sent to: Maciejka.pl ul. Strumykowa 7, 62-200 Gniezno with attached proof of purchase, eg with a invoice or a receipt.
- The Goods shall be dispatched no later than 14 days from the date on which the Customer informed about withdrawal from the Agreement. Direct costs of returning the Goods shall be borne by the Customer.
- We refund the money within 14 days of receiving the shipment.

8. Complaints about the Goods and the operation of the Online Store

Maciejka Footwear Sp. z o.o. Sp. J. as the Seller is liable to the Customer being a Consumer within the meaning of art. 22 [1] of the Civil Code, under the warranty for defects in the scope specified in the Civil Code, in particular in art. 556 and art. 556 [1] - 556 [3] and subsequent Civil Code.

Claims under the warranty should contain the details of the person or entity submitting the complaint (name and surname or full name, contact details) as well as an indication of the reason for the complaint and the content of the request.
- Claims under the warranty should be directed to bok@maciejka.pl along with photographic documentation. The seller undertakes to examine each complaint within 14 days.
- If the Customer returns the Goods to the Seller and the complaint is considered positively, the Seller will reimburse the shipping cost incurred by the Customer. You should keep and send to the Seller the proof of posting the parcel with the visible amount borne by the Customer - it can be a photocopy, pdf confirmation, scan or photo sent by e-mail. If the complaint is not accepted, the Seller provides the Customer with the Goods for collection or sends the Goods back to the Customer at his expense, with a postage paid in advance (at the express instruction of the Customer).
- In the case of considering a complaint in favor of the Customer - the Seller shall, at his own expense, immediately replace the defective Product with one free of defects or remove the defect. This does not affect the Customer's ability to make a statement about a price reduction or withdrawal from the contract in accordance with the applicable regulations. If the product can not be replaced, the product defect is removed or the price is reduced, the Seller will refund the payment immediately, in accordance with applicable law.
- Differences resulting from the individual settings of the consumer's monitor and / or computer (color, proportions, etc.) cannot be the basis for complaints about the purchased goods. However, the consumer has the right to withdraw from the purchase within 30 days of receipt of the package without giving a reason.

Complaints regarding the provision of electronic services:

The Online Store takes actions to ensure that the website and store websites are fully functioning to the extent that results from the current technical knowledge and undertakes to remove within a reasonable time any technical irregularities reported by customers.

Irregularities related to the functioning of the website and the websites of the Store, the Customer may report in writing to the following address: Maciejka.pl, ul. Strumykowa 7, 62-200 Gniezno, by e-mail address bok@maciejka.pl.

In the complaint, the Customer should describe the type and date of irregularities related to the functioning of the Store.

9. Personal data protection

Going to maciejka.pl, the customer will buy goods from Maciejka Footwear Sp. z o.o. Sp. J. with registered office in Gniezno, address: Strumykowa 7, 62-200 Gniezno, entered into the register of entrepreneurs kept by the District Court for Nowe Miasto and Wilda in Poznań, 9th Commercial Department of the National Court Register under KRS number 0000897213, NIP 7842489784, REGON 302371748 (hereinafter referred as Seller), and its data will be processed by the Seller who is the administrator of this data.

In order to create an account and place an order and its implementation in the Online Store, it is necessary for the Customer to provide personal data marked as mandatory in the relevant forms. Providing other data is voluntary.
It is also required to agree to the processing of personal data provided during registration, which is done by checking the appropriate box in the form. -
Customer's personal data are transferred in a necessary dimension to courier companies in order to deliver the ordered Goods. The seller uses the services of carriers: InPost S.A. based in Krakow and DPD Polska Sp. z o.o. with headquarters in Warsaw.

The Customer has the right to access their personal data, as well as rectification, supplementation, deletion and transfer of personal data processed in an automated manner.
If it is found that the personal data processing is unlawful, in particular with the regulation of the GDPR, the Customer is entitled to file a complaint to the President of the Office for Personal Data Protection. For this purpose, you can contact our Inspector of Personal Data Protection by e-mail: bok@maciejka.pl or by post to the address of the Seller's office. -
The Customer has the right to information about the storage and processing of his personal data. For this purpose, please contact the Seller in the manner described in the previous paragraph.

If the Customer has given separate consent, personal data will be processed in order to send notifications and news regarding the Goods and services offered by the Seller in the form of a newsletter containing commercial information.

The Seller may use cookie files when using the services available via maciejka.pl, but the cookie files used by the Seller are associated only with the browser of the computer or other mobile device of the Customer. Detailed provisions regarding the protection of personal data are described on the "Privacy Policy".
10. Dispute resolution and final provisions

A customer who is a Consumer may use non-judicial means of dealing with complaints and redress if interested. Disputes regarding online purchases can be solved through mediation proceedings before the Provincial Inspectorates of the Trade Inspection or before the arbitration court at the Provincial Inspectorate of Trade Inspection. The consumer may also use other methods of out-of-court dispute resolution and, for example, file a complaint through the EU ODR online platform, available at: http://ec.europa.eu/consumers/odr/

In matters not covered by these Regulations, the provisions of the Civil Code, the provisions of the Act on the provision of electronic services and other relevant provisions of Polish law shall apply.
